If you are a salaried person the first step towards income tax return filing is to obtain Form 16 from your employer. Sometimes employer refuses to give form 16 to its employees and employees feel dishearten after that and feel they cannot file a return.But it’s not true, even when your employer refuses to give you form 16 you can still file your income tax return. Now the question arises that what is form 16? Form 16 is the certificate given by the employer to its employee who describes its taxable income and TDS. You can calculate your income without form 16 and its process is given below:
  • Collect your pay slips and find out your taxable income

The employee needs to put together all its pay slips containing net salary and to add it. If a person has worked in more than 2 companies in the previous year then he has to make sure that he adds the pay slips of net salary of all the employers.
  • Find the exact tax deducted

The second step is to check a number of TDS deducted by the employer in the previous financial year. You have to check that amount with form 26 AS. If the amount that is deducted by the employer is same as mentioned in the form then you need not worry. But if both the amount don't match with each other i.e. the amount of TDS employer deducted and the amount which is mentioned in the form then you need to discuss it with your employer.
  • House rent allowance

All the employees who are living on rent are entitled to receive house rent allowance from its employer. For receiving it employee needs to show its rent receipts to the employer and can claim HRA.
  • Claim your deductions

There is various investment which is tax deductible. Under section 80C you have to calculate the amount of deduction such as EPF etc. While the employee is claiming a deduction for provident fund, make sure that he claims only his contribution, not of employers.
  • Income from other sources

If an employee is earning any other income from any other source such as interest on fixed deposit he must add that income also in taxable income.
  • Pay additional tax

If the amount of tax paid by the employee is less than what is mentioned in form 26 AS then the employee must pay the relevant amount of additional tax to the appropriate authority.
  • File tax return

After the above-mentioned procedure is undertaken you can file income tax return safely.
Therefore it is easy to file ITR online even after refusal by the employer to form 16. Just follow the above-mentioned process and file your return.
